I live at the end of a dead end road, no traffic passes further past my house, My neighbour Does not own a car.

Two days ago I picked my van up from storage and brought it to my house and parked it on the road outside to allow me time to pack it and charge it ready for our next trip.

I came home from work tonight to find a letter from the local authority stating,

it is causing an obstruction to other road users(its a 13 ft two berth)(My car's footprint must be the same size.)

and is taking up available residents parking space to the detriment of other residents. (Its right outside my own house Nobody else parks there)

They request I move it IMMEDIATLY.

Does anybody no weather parking on the road is illegal. Can the local authority take matters further.

Any help and advice greatfully received

as far as im aware if it is not attached to your car it is not allowed to be parked on a pubic highway.

which will be the stance your council will be taking, id expect someone has complained about it being there,

your property ends at your gate ,if you do not own the road or the pavemant it is a public highway ,if your lights work during the lighting up times , and is parked the right way way round ,they will probabley allow it to be parked ,some people think that they have right to park outside there property ,i have actually had people come and tell me to move my car while i am going about my trade , i just them to call the police if they think its illegal , i was actually fined for parking my car the wrong way round at night , it should be parked going with the flow of traffic ,yet there are 1000s getting away with it , so if you think they are wrong ,its no good writing here ,its your local council you , should be writing to

"Parking and living in a caravan in the street

by Murdo Maguire - last modified 2007-03-11 10:28

My neighbour intends to live in a caravan whilst parked on the road outside his house. Is this legal?

The street is not a caravan park and your local authority will almost certainly act if he chooses to live in it.

Parking caravans on the street can cause a number of problems, for example they may:

block the street illegally

be a safety hazard to pedestrians, particularly children

prevent or limit access for other vehicles

block windows and shut out daylight

be an eyesore

be dangerous, for example if they are unstable or have gas cylinders attached

If a caravan is illegally parked or is causing a problem, Council officers will investigate to find the owner and see why it is parked on the street. The owner will be asked to remove the caravan and will then be sent a notice requiring it to be moved within 14 days (a copy will be attached to the caravan)

If the caravan is still there after 14 days, the Police will be informed and they will arrange for the caravan to be removed to a storage compound. The owner will only be able to get the caravan back if they pay the costs of removal and storage

Caravan owners should be responsible:

Think of your neighbours before you get a caravan. If you do not have suitable parking at home then arrange to store the caravan at a storage compound - see yellow pages or the local newspapers for details

Remember that parking the caravan on the driveway at the front of your house may still cause problems to the neighbours and, in some cases is not allowed under the title deeds for the house - check with your solicitor if you are unsure

If you need to park the caravan in the street to load or unload, limit this to one day and always park outside your own house. Tell your neighbours what you are doing and how long the caravan will be there

Do not carry out repairs or maintenance on the street

Make sure that the caravan is stable and that any hazards are removed and that gas bottles are isolated whilst it is parked on the street

Do not allow people to live in the caravan or run electricity cables across the street

Never pour dirty water onto the street or into the road gullies - these gullies may go to the nearest beck and cause water pollution

The street is not a caravan park

Any parking, other than loading or unloading or because you are waiting for repairs following a breakdown is against the law

Caravans may not be covered by insurance when parked on streets

It against the law to park on the street at night without warning lights and you should always ensure that you park the caravan with the reflectors facing on-coming traffic"

I hope this clarifies things for you!

Thanks for your input.

I wouldnt mind but I always think of neighbours, I asked there permission, nobody objected, Its only here for a couple of days as there was no other way I could have collected it later from storage.

Its parked right outside my own house facing the right way round considering its a dead end road and im the second to last house im not causing any obstruction to any other vehicle.

I just think its very heavy handed compared to a house further up the road where one always parks a very large box van and the other has a large american camper van.

I feel victamised with my small caravan just because it hasnt got an engine or probably more important a tax disc.

I will be moving it in the morning anyway but the letter just anoys me as i always believe in being so conciencious to others

Parking a caravan on the public highway IS legal if - there are no parking restrictions, it's not causing an obstruction and it's lit at night, even in a built-up area.

Obstruction can be legally applied to any stationary object on the highway so the local authority seem to be within the law BUT if there are no parking restrictions they can't require the space for other people.

Just been on the Police National Legal Database www.askthe.police.uk/content/q629.htm

Q629 asks the same question. with the answer showing as Yes you can park on the road as long as it does not cause an obstruction.

The caravan MUST be lit at night if its parked on the road and comply with the normal parking rules (the nearside must face the pavement so the rear lights are at the rear for approaching traffic).

These rules also apply to any similar trailer parked on the road.

as its now a saturday the council are still uncontactable in relation to there letter so I as yet cannot question them

any comments would be appreciated
