Hello all not been on for a while great to be back, anyway I've been over to my van today to check it and noticed a very small about 3/4" crack on the front panel next to the awning rail about half way up, has anyone else had these sort of problems?? Is it worth me contacting Swift? Just out of warranty typical, will look forward to your comments. Paul

Hello Paul,

What do you mean by 'just out of warranty'?

You have statutory rights that are automatically awarded to you under the Sale of Goods Act (SoGA). Technically there is a limit to when a warranty claim may be brought, though in practice it cant be longer than the life expectancy of a product and for practical reasons 6 years is about the maximum that the courts will allow. It is also subject to reasonable usage, and wear and tear.

Your warranty rests with the parties that signed the contract of sale, which for caravans is usually the dealer not the manufacturer. In some cases it may even be a finance house if you used one.

The problem is proving that the damage you have is the result of a fault that was either present at the time of sale, or there is a design or manufacturing fault rendering the product not fit for service.

If you wish to consider pursuing a remedy through SoGA I strongly recommend that you seek professional legal advice.

Paul My Abbey was 3 years old and Swift were going to replace the rear panel as it had small cracks down 1 side. If it is left and damp gets in they will have to deal with it anyway as it is water ingress, so my guess is it should be covered uinder the water ingess part of the waranty. Also if all else fails ,sale of goods is a good wat to go as the crack was proberbly caused at build through screw hole not being big enough and the screw cracked the panel. It was the same on mine but I had 4 small cracks from awning rail down 1 side.

Go for it, you should get your dealer to act with swift.

Kevin
