Flight rights.

Hi,

My daughter has purchased a flight to America. It transpires that she has been quite ill of late and as a result of a consultant's appointment last week has now been offered an operation which falls within the planned holiday period. At this time she has a flight but no personal holiday insurance as yet.

Is the flight covered by insurance given the agents are ATOL backed? They say monies are non returnable but if she can prove she has this planned operation, should she not be able to have a refund?

I'm not really up on these things so any signposting would be most appreciated.

I think this is one for taking up with a lawyer who is conversant with this type of problem.
However, I wonder how they will interpret the situation.
As it appears, your daughter booked the flight, knowing her medical condition and before an operation was offered.
Now she has been offered the operation it is her choice whether to accept that date or not, something outside the remit of the travel arrangements, and not something which the travel people have imposed or had anything to do with.

Maybe if she can provide a medical letter indicating that the operation is essential and can only be done on that date, it may have a beneficial influence.
I have a feeling that they will not budge, and it would have been down to your daughters own insurance to claim from, but that is too late as the condition is pre existing, which would not normally be covered.

Whatever the outcome, I wish your daughter a speedy recovery.
