Legal access onto highway

Any one know what the legal status is to access the highway outside your home during 'essential highway maintenance' .
Signs and letter appeared today starting the day I am next away and finishing the day I arrive back home!
The letter states they will endeavour to maintain access to your property.
Going to ring them tomorrow to clarify but any advice would be appreciated before I go in all guns blazing!

Hello Gagakev,

As you don't actually tell us what you perceive the problem to be I'll guess you are concerned that you wont be able have vehicular access to your home on the two dates.

We had a similar issue reported on the forum maybe a couple of years ago now with bridge works. Basically the authority can close any public road in their area for scheduled or emergency works. However for scheduled works they should provide all affected properties with notice of the works, and give such property owners time to make alternative access arrangements or to object, (which wont necessarily stop the works).

In the event of emergency works, the contractor should attempt to maintain access to affected properties, unless the nature of the works prevents it. In which case the contractor or the authority should try to assist the property owner in any reasonable way possible.

I do not think it will help any cause to go in with all guns blazing, contrary to popular mythology council officials are actually human, and are more likely to respond to reasoned civil discussion, than belligerence.

Hi Prof, it was just a figure of speech when I said i would go in all guns blazing. I'm a reasonable chappie really :)

Yes you are right need to get the van off/on the drive on both dates, I'm guessing it will be resurfacing now weather that be a full blown operation or just a dressing I wont know until tomorrow.

Just spoke to highway's, Friday they are removing the old surface so can get the van out no problems.
On the Monday they are resurfacing and I wont be able to access until one hour after the new surface has been laid.......it's programmed for most of the day!!
I feel an extra day away is looming :woohoo:

Sounds like a good excuse to extend the trip!

Thinking about it. .... quite a few years ago we had gone away for a week and on the way back over the moors it didn't dawn on me as there wasn't a lot of traffic. ... they had forgotten to put up road closures sign from the small road we had come up on...... we encouted a row of traffic cones and a geezer sat in a pick up ..... this road cut about twenty miles off the journey. ... just asi had disconnected the van and was ready to turn it round on the mover, he came over and said if i could wait half an hour he would be liffting the cones and reopening the road as the tarmac would be okay to run on then so we coupled back up and followed him with his yellow lights flashing to the far end of the roadworks and he removed the cones. ..... that could have quite easily put a few more hours on our journey. ....
