Water Ingress

We purchased a new Bailey Senator wyomme in 2006. On its second service we were informed by the dealer that we have water ingress of 60% on two front side windows & 35% on the around the right side front window. Bailey has given the go ahead to replace the two side window frames dry out were necessary & replace internal wall boarding were necessary. My dealer is currently caring out this repair. When the van is returned to us what should we check to insure there are no further problems & the job is 100% suscesfull? As this van is only two years two months old will we lose out on the trade in value because the dealer knows of the problem when we come to part exchange next year? I understand that we have to accept the repair. I think Baileys should have replaced the Van but have been advised I have to let the dealer carry out the repairs. We are very disappointed this should happen on a top of the range Bailey Caravan. Any help or advice would be appreciated.

I commiserate with you. I would be interested to know who told you that you must accept the repair and how that was determined.

If it were the dealer or Bailey they both have a vested interest in minimising their own costs, though legally they should be ensuring that you have a caravan fit for purpose as at the time of supply.

In fact your claim is against the seller not the manufacturer, and they are obliged under the Sale of Goods acts to ensure a new product is fit for purpose and free of material or design defects at the time of supply.

Because of the age of the caravan, It is not clear cut about replace vs repair, and there has to be some give and take for normal wear and tear, but you should have a caravan of no lesser value than it would have been if no repairs were necessary. If this cannot be be guaranteed then you have suffered a loss and that may be recoverable through action.

I seriously suggest that you seek professional legal advice about the situation, Citizens advice, Trading standards or your own soliciter should be able to offer propper advice when they are in possesion of the full facts.

Sorry to hear your news Malcolm.

In practice I believe the longer you retain a caravan, car whatever , the harder it becomes to demand a full refund based on a total rejection .

Bailey do give a 6 year water ingress warranty as do most of the other major manufacturers. I consider it is reasonable that both Bailey and the dealer are given the opportunity to remedy the fault.

BUT, why don't you demand, in writing , from Bailey and the dealer:

1. That the clock starts ticking again on the warranty, ie 6 years from the date of repair.

2. A written guarantee from both Bailey and the dealer that if you p/x the Wyoming within say the next 4 years they will give you the full book value without penalty for the water ingress repairs.

Do you know exactly how the water got in? Was it defective seals around the windows or something more structural.

Also as this is the true holiday season when you would probably be away a lot I suggest you demand the dealer lends you , free of charge, another Wyoming or caravan of similar cost , size and layout.
