Yes, ours is one of them! Excellent towcar for our 2008 Bailey Pageant 6. Emissions update can't be loaded onto car because of occasional EGR fault. I've got no issue with the car, performance wise and no warning lights shown at all. Has anyone else had same problem and what support, if any, came from VW please?

Although you posted a while ago I thought you maybe interested in the following.
ERG valves on some TDi engines do fail. I am told it is due to corrosion of the electrical connectors. Most seem to fail around the 80-100 k mile mark.

I suspect that you will need to have the EGR fault sorted out and given the car's age I wouldn't expect VW to have any responsibility for doing that work. It's not a UK requirement to have the VW Defeat Device emissions (cheat) update installed as your car should still meet UK emissions tests assuming that all other aspects of the system are working correctly.

Had my emissions recall carried out today as the car was in for some new spring assisters. No noticeable change in engine performance after having the recall carried out. This was on urban, and rural B and A roads. Will measure mpg at some stage but thus far no detrimental effect, which given how the defeat device worked it shouldn't affect normal road usage as it improved emissions during laboratory tests.

From what I have found out is the "cheat" software was only activated during testing on a rolling road dynamometer.
The car detected the ambient temperature ( the emission tests are done at a standard temperature) also the yaw sensor detected the car wasn't moving this triggered the modified engine data maps to be used rather than the real world settings. It must have reduced the power and drivability when activated at the same time as reducing the harmful emissions.
How I understand it the cheat software was primarily for the USA market and there seems to be some doubt about the cheat software being used in European testing, it may have only detected the conditions set by the American standard testing.
After the updated software has been installed the car's performance remains the same as it was.
A lot of the Media spread stories of gloom and doom including heavier fuel consumption and emissions resulting in higher vehicle road fund taxation. This Media has gone a very quiet now the true story has emerged.
My Tiguan was updated and the power, fuel consumption and drivability remains as it was.
There are some stories of loss of power after the upgrade, I think these may have been caused by existing fault becoming noticeable or just psychological or more likely the compensation culture trying to raise its ugly head.
