Purchased a second hand caravan from a dealer(Oct 2nd 2024) have used it a few times and it was in for a service 4th March 2025. Damp was found and a crack around the panel front window. The front locker also has the floor dropped on one side! The dealer have told us Elddis will not repair as its over their 6 year warranty for second hand caravans and the dealer themselves have not stepped up to take any responsibility ( we store our caravan with them too). I paid £5000 deposit and the rest on black horse finance, can any one advise on our options or do we have to suck it up? Feeling very deflated as it's our first purchase and thought that because it's within 6 months the dealership might step up!

Any fault discovered within 6 months of purchase is deemed, in law, to have been present at the time of purchase unless the seller can prove otherwise.
Time to advise the dealer of that fact! (Which they will be only too aware of anyway)
Email them with details of the faults, along with the date you first notified them. That way you have proof they were advised within tge 6 month period.
Your contract I with tge dealer, and it's them that have to put things right.

The caravan retailer that sold you the caravans has not informed you of your rights under the UK's Consumer Rights Act.

Read up about what your rights are, as the dealer or finance house may be liable under the CRA

Classic Elddis problem , repaired 3 in the last twelve months , get back to the dealer and claim your rights under CRA 2015 and get advice from WHICH on suing them

The Which website allows you to input information, and then drafts a letter for you to send to the dealer. For a fee of £100 (app) Which legal services will guide you through the process and give a years support to you. Buying via a finance house strengthens your position significantly. Make sure you record all ares, times and conversations. Save emails, etc and use recorded mail or hand deliver letters.

In this case the repair is definitely the responsibility of the dealer as the caravan is not even 6 months old since purchase. You need to give the dealer ONE chance at a repair before rejecting the caravan. See sections, 9, 10 and 11 plus 19 and 20 of the Consumer Rights Act 2015. I have been done that route a fe times and been successful.

As the caravan is on finance the finance company is the supplier so if dealer refuses to play ball, go straight to the finance company. Keep everything in writing(emails)

The OP gave his purchase date and the date of his last service

According to the OP he was made aware of the damp by the service crew on the 4th March.

6 months from taking ownership dates from 2nd Oct the 6 months times stamp would be 2nd March, so even by the date of the service it was just beyond its 6 month time limit.

Given these details the CRA will not assume its for the dealer to disprove.

This changes the responsibility to the owner to prove the problem arose within the first six months or was actually present at the point of sale (2nd Oct 2024)

The OP should be made aware of this as it can radically change the amount of work necessary to pursue a CRA claim.

Slight error there - 6 months from 2nd October is 2nd April.

Apologies I missed the above however it would be very difficult for the dealer to absolve themselves from CRA 2015 responsibility because of 2 days considering that they probably had to book the caravan in for its service several weeks ago, but 4th March was the earliest the dealership could check the caravan. As a result the date of the booking is important.

The booking for service was made Wed 12th February 2025
