Isn't the 30 day rejection period only applicable to the purchase of new items rather than new?

Unless of course the fault is identified within the first 30 days, and raised with the seller, at which time the 30 day"clock" stops

Do you mean “ used” rather than “ new”?

Applies to any goods sold by a dealer whether new, second, third hand etc. In addition, after the initial 30 days the clock stops if fault is reported within 6 months from date of delivery.

? If 30 days has expired before you report a fault it can't stop the 30 day clock!

I was referring to the period after the 30 days and before 6 months has passed. The clock still stops while the repair is being done. If the repair is not successful then the buyer has the option to reject.

Agreed but that is not what you originally wrote, and its an important difference.

I think we are getting bogged down in detail here. I tried to keep it to the basic point, which is the rejection should be made within 30 days. Given the amount of damp here I cannot believe the owner would want it repaired, but if he does then yes the clock stops until the repair is completed satisfactorily. From what you see of damp problems though, making sure it is done correctly is a possible further problem in itself and any problem may not show up for some time.

From what you see of damp problems though, making sure it is done correctly is a possible further problem in itself and any problem may not show up for some time.
In our case to clarify, the issue was reported to the dealer within 30 days from delivery and it took 3 months for the fault to be rectified. Within days of collection another fault occurred and again another 3 months delay. So although 6 months had passed, we were still within the 30 day limit. We rejected the caravan at 11 months and technically it was still within the 30 days.

Bit of an update -

The dealership have been back in contact today, they have found 20% damp to the wheel arch area (we found 40%). They argued the fact their damp meters are very expensive and calibrated regularly and mine mustn’t be very good. To which I’ve replied and is true, my damp meter belongs to the company I work for who specialise in damp and carry out multi million pound contracts.

They haven’t damp tested the full van , only one area, they are blaming a crack in the battery box which could be true and are replacing that as agreed on collection, I pointed out this was never mentioned or agreed.

They haven’t looked at the list of issues we also found.

We now have a meeting on Friday to resolve the issue.

I am within our returns period as I reported within 5 days.

Thought I would update this .

I (stupidly) gave the dealership the benefit of the doubt and decided we would let them repair the van. So another 2 weeks without the caravan….

Picked it up on Friday, basically just given the keys and caravan was dropped off at our car. Got the caravan home to give it a good check over, and it took all of 30 seconds to see they had not bothered to do the repairs.

They said we had damp near battery box as it had a crack in it, so new battery box fitted - with a crack in it filled with silicone … so what was the point in replacing it? Quick check over with a damp meter and the caravan was still showing damp.

So Saturday morning we returned the caravan and told them we want our old van and the money we paid back. Which apparently can’t be done on a weekend so we have to wait to hear from them on Monday.

Overall I will never go back or recommend anyone go to that particular dealer. Their service is a complete joke . Out of 11 weeks of owning the caravan we had it for a total of 13 days , the rest of the time it was sat at their dealership supposedly getting repaired.

Make sure that as much as possible is in writing especially the rejection letter. If reported within the first 30 days you should get a full refund. However if not, as you have given them more than one chance at a repair, again you are entitled to a full refund.
