Its entirely possible that they are both "2008" models but it depends on when they were built!
Take for instance my 2007 Series 5 Senator Indiana, built in Nov 2006, supplied in Nov 2006 but its a 2007 model?
It would appear that the one with no pir & push button lock was built in 2007, & the other one in 2008.
The only way to tell what model year it is, is to look at the vin number etched on the windows it should read something like this: SGBSF04BY7 followed by 7 numbers, the number after the BY denotes the model year. 7 = 2007 8 = 2008, BY denotes it was made by Bailey.
The dealer can legitamately sell them both as "new" if they've never been registered as sold, but if the vin numbers state one is a 2007 model & the other is a 2008 model & he's advertising them as both being 2008 models, then he's breaking the law under the trades description act, if however they both have 2008 vin numbers, although the spec is slightly different, he's quite within his rights to advertise them as 2008 models. This is because in Bailey's advertising literature it quite clearly states that they have the right to alter the specification without giving any notice.

If you're after one & are prepared to take the earlier spec one, then its a good haggling point & should result in a substantial discount, after all it is a lower spec!
