used speedometer fitted by dealer

I have just bought a Colombus Pioneer (autocruise) from a reputable dealer with an advertised mileage of 41256, nothing was said at handover and when we checked mileage at home it read 45947, and there was a written note in log book that mileage was now higher. The dealer has now admitted that they fitted a second hand Speedo is this legal and is it normal practice? Of course the interesting thing is that it is illegal not to have a Speedo but it is not part of mot.
 
it is illegal under the sale of goods act unless agreed with the purchaser first.
I would never agree to a second hand one being fitted myself.
Btw it would be part of the MOT if any of the engine/electrical indicators did not work ie light up when starting/running..Another thing is by adding extra 4000+ miles also devalues it too !!
