hello all

where do you legally stand if your site fees or storage fees are not paid?

is the owner of the site/storage location allowed to sell on your caravan after a given amount of time?

It all depends on the agreed contract that was established when the storage facilit was taken up.

If no default arrangments are detailed in the contract, then the matter should be taken up with a soliciter, or may be the small claims court.

I don't know anything about the legal position in Spain but it seems perfectly reasonable to me! In the UK, there is the right of lien which gives, for example, a garage the right to keep your car until you pay any outstanding bills. I think that implies the right to sell if the money is not forthcoming, otherwise how will the site owner recoup his losses? It might be bit harsh, though.
 
we have a storage yard and it is hard to believe the amounts of people that have not paid storage and they own 2 year old vans in the years we have been doing it we have had 2 people say they cant pay for storage and just sell there caravan. very hard to say if you can or cant just go ahead and sell the van as so many legal rights now going against the person that is due money.

I hope this may of be so use to you. I have worked at sailing clubs for most of my working life. They have the same issue that you do - to the point where people just dissappear! The way these clubs have to do it does vary but in general you have to first try to make phone contact, then send them a letter informing that they need to pay or remove. If you get nothing from that then you need to send a registered letter to the people. If this then comes back to you then i believe that you can sell the goods but the money that is made gets put into a bank account so that if they do come back and say 'where is my van/boat' then less your costs they get their money back. I am not sure if this is the legal way but i would check with a solictor first, but this is what these clubs have done and it seems to work. Timescale point of view here where i am at the mo is fees are due in january, an audit of boats are done in march/april and then if nothing is heard then they get sold at the clubs annual diner which is in november.

My mate runs a storage on his farm. Yes he has had problems with non payers.

3 letters are sent by recorded delivery with 21 days between each,

He then makes a personal visit to the defaulters home to ensure no one has died or they have been away etc.

If they still don't pay he takes out a small claims court action for recovery of the debt. If the debt remains unpaid the court will send in the Bailiff. If no payment the Court can sell the caravan to settle the debt.

If the site owners sell the caravan without following the correct procedures I think they may find themselves in trouble.

I'm no lawyer and merely relate what my friend does.

A friend owns a villa in Spain and if they do not pay their mortgage for 3 months the lender will reposes the villa and sell for the amount of money owed. (in mt friends case they'd loose about

Hi, I have a friend who lives in a caravan on a site in Benidorm, on a recent visit (two weeks ago) he told me there were a number of caravans on the site for sale, as the owners had not paid their site fees the site owners were selling off there caravans to recover their money. Some caravans were going for as little as 300 euros.
