Just hope my latest purchase is not a faulty one , I do take some tools but to me I would still have to get a AWS caravan engineer to repair mine (after the warranty finish)

BB have you agreed the Dealer will collect and re deliver your new toy in the event of a warranty issue?

That’s one very disillusioned owner, with good reasons too. But blaming himself for not doing pre purchase research is unfair on him. Sources for caravans are far less than for cars. But had he done more research I think he might not have purchased any UK make. Interesting that he cites the Kia 7 year warranty for his car, but it was never required.

This caravan dealer is delivering my caravan free to my seasonal pitch and if any problems they will sort it his word of mouth is enough for me he knows I am not towing again

I think most of us have learnt that Word of Mouth counts for nothing in many cases when you have a problem.

BB , after all the thousands of posts about Warranties and Dealers “promises” word of mouth is as useless as a chocolate teapot!

I must admit having a caravan we leant a lot from sales people and now if purchasing anything of high value, we always ask for promises in writing! Paid off recently with a recent purchase.

Actually just looked at the paperwork we have signed if anything deflective he will try repairing or replacing the goods through warranty

I wouldn't expect anything less! On the Prof's point you may struggle to prove Mrs BB is independent .Do you an independent witness?

If you can back up your recollection of the words spoken by another witness, even better an independent witness or a recording, then in UK law its as good as signed written contract.
Unfortunately if it is your OH is the witness, not always is their evidence admissible even in civil case. If recording, you need to ask the other party if they agree to the recording otherwise it is regarded as a covert recording and may not be admissible and depends on the judge?

It needs to be remembered that most actions brought against a dealer will be under CRA 2015 and as it is legislation, it is probably "criminal action" and not civil? Getting it in writing is always the best course of action as no argument.

If for example the dealer refuses to honour what they have said to BB, would it be civil or criminal? An interesting topic?

That's not the difference between criminal and civil law - most actions againts the seller using the Consumer Rights Act (CRA) will be civil matters but actions that Trading Standards might take under CRA would be criminal matters.

If BB, or anyone else, needed to take the seller to court it would be a civil matter.

Basically as Roger said if BB uses CRA 2015 against the Dealer / Seller it will be a Civil Court matter.
If the Dealer /Seller breaches the CRA 2015 it will be a Criminal Court matter brought by HMG, The Crown , State , call it want you want. In truth this bit has no relevance on here.
Anyway let’s all hope BB has no issues🤞 He’s been a Forumite long enough to know the potential dangers of not following the CYA policy😉

It wasn’t me that reopened the can of worms. I was just observing that we’d discussed the topic sometimes previously, and nothing in my post contradicted Roger.
