Does this apply to privately owned BMWs?
The privately owned BMWs should not be exceeding 70mph on any road in the UK, but we all know many will speed up to 90mph. However if a private vehicle were to travel at that speed, same will probably happen.

It seems that the diesel engine cannot handle high speeds of over 100mph and the police often exceed those limits. I am just surprised that any police force would use diesel powered pursuit cars in preference to petrol?
 
Officially private cars are not affected as it’s the police usage profile that is the reported problem. But what about private cars towing? Would I buy a car with the N57 engine!? Unlikely.
