This was a rather bad taste joke that is funny in that it pokes fun at our antipodean friends and DOES NOT IN ANY WAY ADVOCATE WHAT IS NOW BEING INFERRED.

The moderator knows this and emailed me to give the reasons for it being deleted.

All I can say is that if this is what you lot are reduced to in your desperation to score points them I am truly sorry for you.

If I was banned from a helpforum such as this I would be ashamed. You clearly have none.

Technically it would be libel as it is the written word.

Thanks John - my legal team is looking at this now. It is an interesting area as a forum can apparently be viewed as a conversation.
 
Considering the offending item was deleted weeks ago there is once again more opinion than fact now being aired.

I am now informed that I do have grounds for legal action as the original joke is a matter of record as is all the written comments and it is clear that its content has been delibertatly and wilfully misconstrued.

Action has been instigated.
 
It would seem that Stinky is apologising and this apology is being considered.

It may be of interest to note that:-

An accusation was most definitely made and is now a matter of record.

It is of sufficient seriousness that legal action has been instigated and believe me, neither myself of the legal team I use would waste time on a hopeless cause.

Those making the accusation have been banned several times from this forum for persistent abuse.

If the accusation was made on a works computer then the employer as well as the employee would be considered liable.

We are now considering issuing proceedings to allow clear identification of the individual(s) concerned.
 
Clive, do you not now think you've made your point now? I agree with most of the things you say on these forums but not this legal action. As you say if this was done on a works computer he could lose his job. You are both upset about this and everyone knows you are not a child abuser and he has apologised so you haven't lost face so why not draw a line under it now?

To mix with over people. One thing that has made me a bit mad is that the Moderator has seemed to have not step in when people have made fun with people selling . He has dun it two times where a cup of people have send things. But I have found one thing that help that is to just fink sod them. And forget about it. It is hard some time throw.

The legal issue is up to you. Personally if someone is using their empoyer's computer to post hateful messages, then I'm sorry but in my opinion that should be investigated by their employers too. Most organisations, if they allow employeses to use email and internet, should have clearly written policies and guidelines in place which warn their employees of what action will be taken by inappropriate use of email and internet.

I think Big Roy has the most sensible suggestion here now. As to whether involving the alleged offenders employer, if indeed they have used a works computer, I feel it is double standards to infer that its ok to do so in some instances but not in others. Things have got well and truly out of hand here and if the alleged offender has appologised then its time to call it a day.

As for others suggesting the appology is given - I said as soon as I saw it that we would consider it.

My next meeting is scheduled for Wednesday pm. By that time we should have all the info we require.

As for an employee possibly loosing his job? Do you think I care?? Part of what we do as a firm is work on a voluntary basis with vulnerable indivuduals - as do a lot of us in my professional association -(which incidently is the same professional association that provide free legal advice). If I am accussed of being a paedophile then this would have to stop.

One of the items on the agenda for Wednesday is putting a monetory value on such a distressing event.

Clive, your argument doesn't stand up, you say that your work with vulnerable people will have to stop if you are accused of being a paedophile, you have not been accused, this was some locker room banter that has got out of hand. If you do decide to take this to court as soon as you set foot in the courtroom it then becomes a matter of record and thats the point that it will jeopardize your employment whether you win your case or not. I'd keep it in house if I where you.

As for my job - thanks for your concern but I own the business! - and the Professional Association I belong to provides legal advice as part of my membership.

The work we do on behalf of a charity is to do with the disabled. If you did anything like this you would know he checks that are now in place.

As for the accusation it is a matter of record and was made by more than one person.

One of which has offerered an apology. If no accusation - why the apology?

As for going to court - I have no problem with that. I have got nothing to loose except a bit of my time. Do you really think someone like me is going to sit back and take that sort of c**p from loose mouthed idiots that have been disrupting this Forum for weeks - so much so that they were banned - but kept comming back with increasingly atrocious behaviour?

The only reason they picked on me was because I told a joke and they saw a chance to bully me off the Forum.

It looks to me like the apology was for the mis-understanding and not for any acusations.

It seems that you've scared the pants off him to such a degree that I bet he doesn't even visit this site anymore.

Think about how many times he's made a grovelling apology. What more can the courts do other than make hime aplogise some more?

Your certainly right about it being nice and "quiet" with no sillyness going on.

A lot of people think that an action such as I have started will be a grand affair with Judges in wigs etc. It isn't like that usually. If we proceed - a summons will be issued and evidence presented and they have the right to reply via their own legal team. It only goes to court where generaly the outcome is in doubt. Not the case here as we have the record of the postings as well as the evidence of their abuse of the forum, impersonating others as well as the moderator.

It will be VERY VERY hard for them to justify their actions. But they must be given the chance of course.

Please do not think I am a vindictive person but we have now established the employer of one - and yes it would seem that a lot of what was said was using the employers time and hardware.

We are currently obtaining the employers standard Terms and Conditions of employment. What we do next will be decided on Wednesday at our next meeting.

How an employer would view situation we can only guess at.
