Hol in 2 weeks but no van due to incorrect order taken at dea...

Hi can anyone help or offer there advise? We had our van stolen in Feb this year Lunar Lexon twin axle 2004 We are insured with the caravan club who were excellent and gave us the option of a new replacement van with in 4 weeks We was happy with our van so ordered a new lunar quasar fb twin axle. We had a air con unit on the roof and was told the van needed the roof bar fitted at manufacture and the van wouldnt be ready untill 21 June 2008, So three days before collection from Campbells of Preston they informed us that the roof bars hadnt been fitted so the air con couldnt be fitted. They tryed to palm me off with the air con under the set but it wasnt climate control This is very importatant to ourselves because we have a daughter that is epileptic and temp control can control the fiting, Campells have offered us no help and havent been in contact with us for over a week, only today I have phoned up to ask for my deposit back after a heated debate they reluctanty agreed. I told them about our hols that are booked for 5 weeks this year and asked if they had any ideas to help us There responce was it not there problem THATS ALOT CAMPELLS I quote "At Campells we realise that sales is only one part of the equation and that an excellent after sales service is paramount" but not in the case if we mess the order up should be in the small print. I cannot believe how we have been treated and very dissapointed about our hols any ideas?

sorry to hear about your stolen van. with reguards to this van i would cancel your order, get you deposit back and go and order a bailey from chipping sodbury caravans. it might not be a lunar but i went from a single axel brand new sterling elite that i rejected ( two of them ) and bought a new twin axel wyoming. you might have to travel but its worth it and the service is second to none.

my friend has had a lot of trouble with his 2007 lunar lexon and the gas struts have gone straight through the front panel. did you have any trouble?.

Hello Martin,

I am very sorry to read of your disappointing situation, however I am not legally trained, so I always recommend that you seek the advice of a professional rather than simply relying on my jottings.

From the details you have supplied, it seems that you have already been able to cancel your order and have had your deposit returned. This I believe will be as far as you are likely to get with the dealer.

When you agree a contract with a reputable company, you will be agreeing to certain terms and conditions which should have been supplied to you or explained. As part of those conditions most organisations seek to limit their liability in the event that a contract cannot be fulfilled (i.e. correct/goods or services on time). Unless you have negotiated and agreed variations to that contract the dealer liability will be limited to the value of the goods and will exclude any subsequent or consequential losses.

Consequential loss contracts are very rare in the retail sector, and in general the losses a consumer may endure are few and of very low value. It would usually cost more in legal fees to attempt recover than the value of the loss.

The other problem is defining a 'consequential loss' The loss has to be tangible, and shown to have arisen as a direct result of the failure to meet contract. This may seem silly but you contracted the dealer to supply a caravan, he was not contracted to supply a holiday, so the loss of the holiday opportunity is not the dealer responsibility, however, if you had contracted to purchase the caravan, and on the basis if the delivery date then booked a pitch and paid a non returnable deposit on the basis of having a caravan to use, but then as the caravan failed top materialise, the lost deposit may be construed as a consequential loss.

As I said at the top you need to seek professional advice.

Hi martin

What a shame Campbells and Lunar have let you down especially when you an dyour family were looking forward to your holiday.

Firstly it is again reassuring to hear how good the caravan clubs insurers are in time of need.

Do you really want another Lunar? Have you looked at other manufacturers and dealers?

I'll lay a penny to a pound a dealer like Chipping Sodbury Caravans and Bailey will supply exacly what you need, aircon and all in time for your hols, if you ask them nicely and explain your daughters problems.

Jo-anne is dead right and learnt the hard ay, unfortunately.
